Please read these Terms of Service ("Terms," "Terms of Service") carefully before using the eGarage platform, mobile application, and related services operated by eGarage ("us," "we," or "our").
Your access to and use of our services is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all workshops, garages, mechanics, admins, and other users who access or use our services.
By registering an account, creating a workspace, or using the platform, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access our services.
1. Services & SaaS Platform
eGarage provides a cloud-based workshop and garage management platform. Features include digital vehicle checklists, checklist template customization, vehicle history tracking, customer registries, custom branding, and sharing vehicle health reports via generated links or PDFs.
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the service.
2. Important GDPR Role Distinction (Data Processing Agreement)
In accordance with the European Union General Data Protection Regulation (GDPR) and other applicable privacy regulations:
- Data Controller (The Garage/Workshop): The subscribing garage, workshop, or business entity is the Data Controller for all customer details, vehicle records, license plates, and checklist logs uploaded to the platform. You are responsible for ensuring a legal basis exists for collecting and processing your customers' personal data.
- Data Processor (eGarage / Veylor): eGarage acts strictly as a Data Processor (or Data Handler), hosting and processing the operational records on your behalf and in accordance with your instructions.
- Sub-processing: We employ secure, vetted infrastructure sub-processors (such as cloud hosting providers) to host workspace database records. Data processing agreements are maintained to ensure data security.
If your end-customers make requests to access, rectify, or erase their personal data, you as the Data Controller are responsible for addressing these requests. eGarage will provide reasonable assistance where necessary.
3. Account Registration & Workspace Obligations
When creating an account or workspace on eGarage, you agree to:
- Provide accurate, current, and complete email, business, and billing information.
- Maintain the security of your password and credentials. You are fully responsible for all activities that occur under your user accounts or workspace.
- Notify us immediately of any unauthorized access, use, or security breach.
- Ensure your mechanics, technicians, and team members comply with these Terms.
- Avoid using the platform for any illegal, abusive, or unauthorized purposes.
4. Platform Limits & Subscriptions
Certain workspace features, such as the maximum registered vehicles, active customers, or monthly filled checklists, are governed by your selected subscription plan. If you exceed your plan's limits, you may be restricted from registering new records or filling checklists until you upgrade or your billing cycle resets.
Fees and billing parameters are specified upon subscription setup. We reserve the right to adjust plan pricing with reasonable prior notice.
5. Intellectual Property
Our Intellectual Property: eGarage, including its software, layout, styling, brand, logos, and features, remains the exclusive property of eGarage and its licensors.
Your Data: You retain full ownership of all workshop operational data, customer lists, vehicle registries, and filled checklists uploaded by your workspace. We claim no ownership over your client data, though you grant us the limited license to store, process, and display it to your authorized workspace members and generate report links for your clients.
6. Security & Photo Uploads
If you utilize the platform's camera features to take and upload photos of vehicle defects or status checks, you must ensure you have the appropriate permissions and that no unnecessary personal data (such as faces or unrelated background material) is recorded. All media files are hosted securely and are accessible via the generated checklist link.
7. Limitation of Liability
To the maximum extent permitted by law, eGarage (and Veylor) shall not be liable for any indirect, incidental, special, or consequential damages. This includes loss of profits, data, goodwill, or service interruptions arising from your use of the platform.
Our total liability for any claims arising out of or related to these Terms shall not exceed the total fees paid by you to us in the twelve (12) months preceding the claim.
8. Disclaimer of Warranties
Our services are provided on an "AS IS" and "AS AVAILABLE" basis. eGarage disclaims all warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the service will be entirely uninterrupted, secure, or free of minor bugs, or that the generated checklists will meet all local vehicle inspection regulatory guidelines automatically. Compliance remains the responsibility of the workshop.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which our parent entity, Veylor, is established, without regard to conflict of law provisions.
10. Changes to Terms
We reserve the right to modify or replace these Terms at any time. Material changes will be communicated via in-app alerts or emails before taking effect. Continued use of the platform constitutes agreement to the updated Terms.
